Donald Trump's lawyers have filed another appeal Hush money case to challenge the trial judge's order denying that he was entitled to presidential immunity.

Trump's lawyers are also challenging Judge Juan Mercant's “recusal” of the hearing and an earlier ruling on how documents are made public.

In a brief two-page notice of motion filed Wednesday, Trump's attorneys alleged the judge overstepped his authority in those rulings and asked the appeals court to hold a hearing on May 6.

The court filing, posted in the public docket, does not indicate that Trump is seeking an expedited hearing in the appeals court to delay a hearing on the notice of motion.

After CNN reviewed the petition in the docket, the filing was sealed.

The case is the latest in a blitz to grind the gears of the investigation. Trump's attorneys earlier this week asked an appeals court to halt the investigation into the pretrial ad and gag order. Both times, requests for emergency measures to delay the trial were quickly denied.

This story is breaking and will be updated.
